When you are part of a family, something that has a big effect on one person will consequently affect everyone.  It could be passing a driving test, winning the lottery or something more sinister like a family member becoming ill. If this family member has not received the level of care they deserve it could have a long term effect on your family as a whole.
Health and wellbeing is one of the most important aspects of family life and medical negligence can affect families in a number of ways, and can range from mis-diagnosis to surgical errors.
In early 2016 research revealed that at least 340 blunders are occurring on NHS maternity wards every day and over 300 ‘never events’ are happening yearly in UK hospitals.
It is important to fully understand what medical negligence is due to the devastating affect it can have on your family. It is also important to understand how it can affect your family, and how you can claim for it.
Medical negligence claims can be brought against doctors, hospitals, health professionals and NHS trusts where it can be shown that a lack of skill or incompetence has caused harm or injury, with the majority of claims being funded on a no win no fee basis.
There is a three-year time limit during which you can make a claim from the date which you became aware negligence had occurred. However, there are a number of exceptions to this rule. If the victim is under 18 when the negligence occurred, they have three years from the date of their 18th birthday, while if the injured party suffers from a mental illness, they are given three years after fully recovering.
It is recommended you speak to qualified medical negligence solicitor if you think you or a family member has been the subject of medical negligence.
The infographic below highlights some of the mistakes made by hospitals during surgery and how much compensation the individual received.
