Affidavit of Custody (Sole Custody for Unmarried Single Parent of Minor)

I just got a nice news from the Regional Trial Court about my appeal for my sole custody of my child. I had my affidavit of Custody last year and I found out that I needed to authenticate it from RTC QC Branch for the DFA to authenticate it also and ribbon it. This is all what I did last year, I made the Affidavit of Custody with another legal document Joint-Affidavit of Two Disinterested People that will which going to be the supporting document later on.

Needed:

  • Valid ID's
  • Birth Certificate/ Baptismal Certificate of you minor child
  • Certificate of No Marriage
  • Your Statement written form
  • Two people known you (whole single parent life)
  • The copy of your witness's IDs
  • Cash: 50php per legal document

Steps:

  • Make your own statement in written form how you became a Single Parent. (write all, just tell the truth and nothing but the truth)
  • You will need a Lawyer (Public or Private) 
  • You will going to need witnesses (not Family-related) this will be needed for the Joint-Affidavit of Two Disinterested People that supports your Affidavit of Custody.
  • After they made the legal document, you will need to sign and will be needing a valid ID's of you and the two witnesses (xerox)
  • They will notarized this documents, (2 documents and 3 copies each)
  • Whenever you're ready, You go to the Regional Trial Court of your city (Quezon City as mine) and ask the information desk for the Authentication. ***I had someone to arrange it in the RTC QC because she works there, easier and faster for me. 
  • Payment: 50php per documents (Only the legal document)
  • You will wait for like 4-5 working days and they will release it.
