How Constitutional and Ethical is Declaring PM Candidate Before Lok Sabha Elections?

Posted on the 02 April 2014 by Shruti2910

This is my favorite season. The Lok Sabha elections. I love the tempo of this country. From nukkad discussions to corporate parties. That is what I perceive from the social media activities happening on my wall these days. Any 'opinion' about anything is often spammed with "Vote for Modi", "AAP is the only solution" or funnily, " Har hath shakti, har hath tarakki" comments and tweet backs.

Cribbing apart, let us get to the point.

On 13th September 2014, Mr. Rajnath Singh declared the PM candidate of BJP after party's meet at Goa. “ The Bharatiya Janata Party (BJP) on Friday announced Gujarat Chief Minister Narendra
Modi as its prime ministerial candidate for the 2014 general elections. The announcement
came after a meeting of the party's parliamentary board here this evening, which unanimously decided to project Modi as the prime ministerial candidate. “We have projected Narendra Modi as our PM candidate,” BJP President Rajnath Singh told media here after the parliamentary board meeting .”

Narendra Modi undoubtedly is the toughest and strongest competition for others, thanks to powerful projections. However, I doubt the ethical stand of BJP when it is playing the election game on name. BJP's TV advertorials openly says, "Abki baar, Modi ki sarkar"Questions rise in me about the constitutional validity of such announcements in current electoral system and parliamentary democracy. 1) Isn't BJP (BJP, because other parties have so far not declared their PM candidate) violating the rights of Member of Parliament, who as per the constitutional provision choose their leader? The PM then on heads the council of minister.2) Doesn't the entire scene about declaring and projection the PM candidate by a party violate the provisions of Representation of People's Act 1950? 3) According to the constitution, the PM post doesn't represent people. When projecting a person as a PM candidate already before elections, claiming on whose government it will be and asking people in rallies to vote for, in this case Modi (which is very clear and loud), doesn't the party violate the right of citizens to elect MP and allow citizens to participate in electing the PM?

How constitutional and ethical is declaring PM candidate before Lok Sabha elections?

BJP's advertorial across media

 4) What would be than role of citizens of India, how during elections the votes would be accounted for the declared candidates? The current declaration of Prime Ministerial candidates can be honored by whom, the political party, the current parliament or election commission? Is there a provision for the direct election of Prime Minister?5) Were the candidates who stand for the post of MP/MLA present in the meet when the declaration of PM candidate was done? Were they already given tickets? What if my to-be representative, my MLA/MP doesn't approve of this candidate after citing his public's flavor?  6) What actions does the election commission take on these? How much does a party like this respects and values constitution and democracy? Correct me if am mistaken, enlighten me if there are answers
